UbicutoThese terms apply to any use of the software and services of Ubicuto (a trading name of Maasbach Finance & Audit B.V.).
The service
Ubicuto is accounting software for e-commerce sellers: payout reconciliation, VAT determination per order line, general ledger, reporting and exports. We do not file tax returns and do not provide tax or legal advice; the customer remains responsible for the accuracy and timeliness of their filings.
Account and use
The customer is responsible for keeping credentials confidential and for all use under their account. The service may not be used for unlawful purposes or to circumvent security measures.
Prices and payment
Subscriptions are monthly, exclusive of VAT, with no set-up fees, and can be cancelled monthly effective at the end of the current period. Price changes are announced at least 30 days in advance.
Availability and support
We aim for high availability and prioritise incidents that block processing (first response within four hours on business days; other questions within one business day). Planned maintenance is announced in advance.
Data and export
The administration remains the customer's property. Export is available at any time, including the audit file and source documents, also after cancellation; there are no exit fees. After termination we delete the data within 30 days in accordance with the Data Processing Agreement.
Liability
Our total liability per event or series of related events is limited to the fees paid by the customer in the twelve months preceding the event. Liability for indirect damage, including lost profit, is excluded, except in cases of intent or deliberate recklessness.
Changes and governing law
Changes to these terms are announced at least 30 days in advance. The agreement is governed by Dutch law; disputes are submitted to the competent court of the Midden-Nederland district court.
